Class action lawsuits and the justice that they are supposed to enforce have become of great concem to legislators in recent years. The traditional ruIes of tort liability cannot completely support the court decisions that have been reached. The rulings, however, are clearly in the interest of giving victims the justice that they are due. Legal scholars, such as Jules Coleman, claim that the conflicts between tort liability and class action justice cannot be reconciled in our legal system. I propose (...) an avenue of analysis whereby the principles of justice that support tort law are preserved as needed for modem issues, yet at the same time address the genuine public policy concems in these class actions. We will look at several theories of indicative conditionals grouped into three categories: those that base its semantics on its logical counterpart (the material conditional); intensional analyses, which bring in alternative possible worlds; and a third subgroup which denies that indicative conditionals express propositions at all. We will also look at some problems for each kind of approach.

This article considers the relevance of time theory for Beck's theory of reflexive modernization and vice versa. It focuses in particular on discontinuity in the context of continuity, on decontextualization, naturalization and responsibility as key concerns of both perspectives on the industrial way of life. It makes explicit the temporal underpinnings of that cultural form with respect to five Cs: the creation of time to human design (C1), the commodification of time (C2), the compression of time (C3), the control of (...) time (C4) and the colonization of time (C5). It concludes that explicit concern with temporal relations shows reflexive modernization in action and facilitates improved knowledge for deliberative change. (shrink)

This article seeks to examine Rorty's contention that literary narrative, not political philosophy, is best able to address the problems of the West. It argues that although Rorty's conception of the novel as a valu able and informative medium is credible, he does not establish it as a valid alternative to political philosophy. Moreover Rorty retains the sort of reasoning that is characteristic of political philosophy, despite his assertions to the contrary.

How should biological behaviour be modelled? A relatively new approach is to investigate problems in neuroethology by building physical robot models of biological sensorimotor systems. The explication and justification of this approach are here placed within a framework for describing and comparing models in the behavioural and biological sciences. First, simulation models – the representation of a hypothesis about a target system – are distinguished from several other relationships also termed “modelling” in discussions of scientific explanation. Seven dimensions on which (...) simulation models can differ are defined and distinctions between them discussed: 1. Relevance: whether the model tests and generates hypotheses applicable to biology. 2. Level: the elemental units of the model in the hierarchy from atoms to societies. 3. Generality: the range of biological systems the model can represent. 4. Abstraction: the complexity, relative to the target, or amount of detail included in the model. 5. Structural accuracy: how well the model represents the actual mechanisms underlying the behaviour. 6. Performance match: to what extent the model behaviour matches the target behaviour. 7. Medium: the physical basis by which the model is implemented. No specific position in the space of models thus defined is the only correct one, but a good modelling methodology should be explicit about its position and the justification for that position. It is argued that in building robot models biological relevance is more effective than loose biological inspiration; multiple levels can be integrated; that generality cannot be assumed but might emerge from studying specific instances; abstraction is better done by simplification than idealisation; accuracy can be approached through iterations of complete systems; that the model should be able to match and predict target behaviour; and that a physical medium can have significant advantages. These arguments reflect the view that biological behaviour needs to be studied and modelled in context, that is, in terms of the real problems faced by real animals in real environments. This article situates Edward Gresham'sAstrostereon, or A Discourse of the Falling of the Planet(1603), a little-known English astronomical treatise, in the context of the cosmo-theological debate on the reconciliation of heliocentrism with the Bible, triggered by the publication of Nicholas Copernicus'sDe revolutionibus orbium coelestiumin 1543. Covering the period from the appearance of the ‘First Account’ of Copernican views presented in Georg Joachim Rheticus'sNarratio Prima(1540) to the composition ofAstrostereonin 1603, this paper places Edward Gresham's commentary and exegesis against the background of (...) the views expressed by his countrymen and the thinkers associated with the Wittenberg University – such as Philipp Melanchthon, Caspar Peucer, and Christoph Rothmann. Comparing the ways in which they employed certain biblical passages – either in favour of or against the Earth's mobility – the paper emphasizes Gresham's ingenious reading of the Hebrew version of the problematic excerpts, and his expansion of the accommodation principle. In 2012 the author completed a series of drawings that, while figurative in form, were structurally based on and derived their inspiration from Robert Motherwell’s abstract series, Elegies to the Spanish Republic. This wholesale 'borrowing', 'quotation' and 'citation' raises the questions addressed in this article. What does it mean to engage in acts of appropriation now? And, more importantly, can such acts of appropriation draw on the spirit of the 'original' work to make a difference?

In lieu of an abstract, here is a brief excerpt of the content:Sozzini’s Ghost: Pierre Bayle and Socinian TolerationBarbara Sher TinsleyPierre Bayle’s Philosophical Commentary (1686–87), a Huguenot exile’s response to the Revocation of Nantes, established its author as a defender of free conscience for pagans, Muslims, Jews, atheists, Catholics, Protestants, Anabaptists, and Socinians. 1 The virtues of Pagans and Atheists are most fully treated in Bayle’s work on the comet. 2 In this work pagans, Catholics (whom Bayle equated with pagan (...) idolators), and atheists were compared to the advantage of the latter, a conclusion that caused widespread scandal and for which Bayle was obliged by his church to write an apology or clarification found in his Dictionary. 3 In toleration there was no juste milieu. 4 Everyone must act according to conscience no matter how errant. Bayle reiterated a position taken in his criticism of the Jesuit Louis Maimbourg’s History of Calvinism. 5 In it Bayle first enunciated the principle that he noted frightened readers and caused a scandal, namely, that error disguised as truth must be allowed all the privileges of truth, i.e., must be permitted to be believed by those convinced they had found truth. This doctrine of errant conscience was basic to Bayle’s understanding of God and man’s search for Him; and after his death it became basic to concepts of individualism, free [End Page 609] inquiry, free speech, and inalienable rights, concepts which were all made concrete during the Enlightenment. Forcing conscience was wrong. 6Bayle’s lack of partisanship in treating religious history invited criticism from Calvinists in Holland. He wrote to Mr. Pecher, a minister at Emmerick, that in his Dictionary he had avoided passionate prejudice with respect to Jesuits or to any other subject. 7 But had he also avoided an indifference to dogma? Not according to his chief critic who was his erstwhile patron turned enemy, Pierre Jurieu, Pastor of the Reformed church of Rotterdam and theologian in the Ecole Illustre. This school, founded expressly for Bayle and Jurieu by the city council of Rotterdam, 8 allowed Bayle to teach philosophy and history. Since Jurieu thought Bayle “indifferent” to dogma, he believed him to be a covert Socinian or atheist. In 1693 he managed to have Bayle dismissed from his teaching post.Indifference was a concept that started with the ancients, particularly Stoics, Skeptics, and Cynics, who regarded everything except virtue as matters of indifference, a posture with which many of Bayle’s writings, though not all, seemed to agree. In scholastic logic indifferentism meant that things were neither particular nor universal but indifferently so according to the viewpoint from which they were regarded. Jurieu made the charge of indifferentism in 1687. 9 He remarked then of Bayle’s concept of the erring conscience that it was “developed with a view to establishing tolerance and a general indifference of all sects and even of all religions.” 10 Bayle was not indifferent to doctrine. He remained loyal to the Reformed faith, defended orthodoxy, and in a letter to his cousin protested that he was ready to show that his work on comets contained nothing that was contrary to right reason, Scripture, or the Confession of faith of the Reformed Church. 11 Paul Dibon noted that Bayle was especially consistent in his concern for divine transcendance rather than indifference. 12 Henry Kamen wrote that Bayle wrote in “complete theological indifference,” 13 a statement ignoring Bayle’s disapproval of much theological heterodoxy, the orthodoxy of others. While Bayle was usually non-partisan, he was never indifferent. If well-designed, the results of a Randomised Clinical Trial can justify a causal claim between treatment and effect in the study population; however, additional information might be needed to carry over this result to another population. RCTs have been criticized exactly on grounds of failing to provide this sort of information Evidence, inference and enquiry. We deduce that, by predicting variability through interpolation, ISCTs aid with problems regarding extrapolation of RCTs results, and therefore in assessing their external validity. Furthermore, ISCTs can be said to encode “thick” causal knowledge —as opposed to “thin” difference-making information inferred from RCTs. Hence, ISCTs and RCTs cannot replace one another but rather, they are complementary in that the former provide information about the determinants of variability of causal effects, while the latter can, under certain conditions, establish causality in the first place. Montague was born September 20, 1930 in Stockton, California and died March 7, 1971 in Los Angeles. At St. Mary’s High School in Stockton he studied Latin and Ancient Greek. After a year at Stockton Junior College studying journalism, he entered the University of California, Berkeley in 1948, and studied mathematics, philosophy, and Semitic languages, graduating with an A.B. in Philosophy in 1950. He continued graduate work at Berkeley in all three areas, especially with Walter Joseph Fischel in Arabic, with (...) Paul Marhenke and Benson Mates in philosophy, and with Alfred Tarski in mathematics and philosophy, receiving an M.A. in mathematics in 1953 and his Ph.D. in Philosophy in 1957. Alfred Tarski, one of the pioneers, with Frege and Carnap, in the model-theoretic semantics of logic, was Montague’s main influence and directed his dissertation (Montague 1957). This essay uses Garland’s framework from The Culture of Control to suggest an agenda for critical penology. This includes, as well as the analysis of choices actually made and the cultural repertoire actually available, describing and advocating other possible choices, and analysing the conditions of possibility for the adoption of other (better) policies and practices; and examining the implications for the future of choices which are currently being made. Carlen’s Women and Punishment: The Struggle for Justice and Garland’s edited collection (...) Mass Imprisonment in the USA are examples of these penologies. Another way in which penologists, social theorists and philosophers can attempt to influence policy choices is to contribute to enlargement of the available cultural repertoire. The development and promotion of restorative justice is given as one example of this; another is work by philosophers such as Duff, Matravers and Norrie which addresses questions such as the source, nature and limits of penal communities; the basis of political obligation, and the relational nature of responsibility for crime. In the 1960’s, both Montague (e.g. 1970, 222) and Grice (1975, 24) famously declared that natural languages were not so different from the formal languages of logic as people had thought. Montague sought to comprehend the grammars of both within a single theory, and Grice sought to explain away apparent divergences as due to the fact that the former, but not the latter, were used for conversation. But, if we confine our concept of logic to first order predicate logic (or (...) FOPL) with identity (that is, omitting everything which is not required for the pursuit of mathematical truth), then there are of course many other aspects, in addition to its use in conversation, which distinguish natural language from logic. Conventional implicature, information structure (including presupposition), tense and time reference, and the expression of causation and inference are several of these, which combine as well with syntactic complexities which are unnecessary in first order predicate logic. In this paper I will argue that such distinguishing aspects should be more fully exploited to explain the differences between the material conditional of logic and the indicative conditional of one natural language (English).
